1. General Information
Eklektika Sp. z o.o. provides the web application Eklektika Lexi (hereinafter: “LEXI”, “Application”) as a tool to support language learning through artificial intelligence.
LEXI is a language training platform designed to improve users’ language skills through exercises involving virtual AI tutors. By using the Application, the user (“User”) accepts the provisions of these Terms of Use. If you do not accept the Terms of Use, you may not use LEXI.
1.1 Nature of the System and User Awareness
According to the statement of the technology provider (Aidia ApS), the platform on which LEXI operates is not considered a high-risk system within the meaning of the AI Act. LEXI has been classified as a limited-risk system. By using LEXI, the User acknowledges that they are communicating with a virtual tutor powered by artificial intelligence.
2. User Account
To use LEXI, you must create an account by providing true and complete information. The User is fully responsible for the security of their login data and for all activities performed using the account.
You agree to:
- not create multiple personal accounts,
- not share your account with third parties,
- immediately report any unauthorized activity on the account.
3. Purpose
LEXI is intended for personal, non-commercial use only. It is prohibited to:
- sell or share access to Lexi,
- use it to provide language services to third parties,
- use it for purposes other than language learning.
4. Storage of Conversations and Recordings
User conversations with the virtual tutor are temporarily stored for the purpose of:
- improving the quality of the service,
- allowing the user or tutor to review the history (if you use LEXI in connection with a course with a human tutor).
Conversations are processed by AI systems for a maximum of 30 minutes after the end of the lesson session. In the case of integration with a course conducted by a tutor, sessions are stored and may be available to the tutor or tutors appointed by Eklektika.
5. AI-Generated Content
We use artificial intelligence to generate content, including conversations with virtual tutors. We strive to provide a respectful, accurate, and inclusive learning environment, but there may be instances where AI-generated content is perceived as: inaccurate or incorrect, offensive or inappropriate, misleading or factually wrong.
Such content may result from the operation of language models that do not always rely on up-to-date or verified data. LEXI is designed as a tool to support language learning, not as a source of definitive facts, professional advice, or expert opinion.
Dear User — maintain a critical approach to AI-generated answers, treating them as educational content rather than authoritative information.
Eklektika Sp. z o.o. is not responsible for:
- consequences resulting from the use of AI-generated information,
- any damage, misunderstandings, losses, or harm resulting from content created by artificial intelligence.
We encourage you to report any inappropriate content to: [email protected], which will help us further improve the application and ensure a safe learning environment.
Please note that AI tutors may present information in a convincing manner, but they are not human and cannot guarantee the accuracy of information. For important, personal, or sensitive topics, always rely on trusted, human sources.
As part of LEXI’s operation, voice and text data are processed using AI models provided by OpenAI, Anthropic, and Groq. Processing includes, among other things, generating responses, language analysis, and speech recognition. 6. Fair Use and Limits
By accepting these Terms of Use, you agree to use LEXI in accordance with the principles of fairness and the intended purpose of the application.
Monthly usage limits apply:
- 2,000,000 characters for the AI chat,
- 100,000 characters for the pronunciation tool.
Limits may be individually adjusted. Eklektika reserves the right to suspend accounts in case of abuse.
7. Prohibited Activities
It is forbidden to use LEXI for:
- illegal activities,
- publishing offensive, threatening, or spam content,
- impersonating others,
- disrupting the operation of the application,
- gaining unauthorized access to the system,
- activities unrelated to language learning.
8. User Age
LEXI is intended for adults (18+). Persons under the age of 18 may use the Application only under the supervision of a parent or guardian.
9. Payments and Access
Using LEXI is subject to payment.
- Service pricing is prepared individually for each business client and depends on the number of licenses purchased.
- Payments are made based on an issued VAT invoice.
- Each license entitles one unique user to access the platform.
- Sharing an account among multiple users is strictly prohibited. Licenses are non-transferable.
10. Termination of Service
To terminate the use of LEXI, you must send an email notice to [email protected] by the 25th of the month, effective at the end of that month.
11. Access for Organization Administrators
Administrators on the business client’s side (company) may have access to usage statistics and data on users’ learning progress. These data are provided to monitor engagement and effectiveness.
Administrators do not have access to the content of user conversations with AI tutors. However, this feature can be enabled by the service purchaser (e.g., employer). If enabled, the purchaser is required to clearly inform their employees (Lexi users) that their conversations may be shared with designated administrators.
12. Organization Responsibility
Organizations using the service are responsible for ensuring that all users comply with these Terms of Use. Organizations must ensure that all users are adults (18+). They must also comply with the EU Artificial Intelligence Act regulations, particularly by not using LEXI as the sole source for assessing or classifying users without human involvement. Additionally, service-ordering organizations must clearly inform users that they are interacting with an AI-based system to avoid any risk of deception.
13. Changes to the Terms
Eklektika Sp. z o.o. reserves the right to amend these Terms of Use. Users will be informed of any changes via the website or within the Application. Continued use of the Application after changes signifies acceptance of the new Terms.
14. Copyrights
Pursuant to the Act of 4 February 1994 on copyright and related rights (Journal of Laws of 2022, item 2509), the use of copyrighted ideas, solutions, copying, distribution of photographs, fragments of graphics, and descriptive texts for commercial purposes without the author’s permission is prohibited and constitutes a violation of copyright and is punishable by law. The materials made available to the User within the Lexi Application are subject to copyright and are protected under the provisions of copyright and related rights.
15. Personal Data Protection
Eklektika makes every effort to protect the personal data you provide us. We have implemented procedures in accordance with applicable laws, which you can read more about in the Lexi – Virtual AI Language Tutor Privacy Policy.
